Partner George Sax successfully defended a multinational food manufacturer in a product liability and consumer fraud class action in federal court in Chicago. The plaintiff voluntarily dismissed his complaint after the filing of a motion to dismiss that raised preemption defenses under both the U.S. Pure Food and Drug Act and the Illinois Food, Drug and Cosmetic Act .  The case was dismissed before responses to the firm’s motion were filed or argued and was not refiled, resulting in a win for our client.
