Scharf Banks Marmor Wins Appeal Upholding Cook County Sheriff’s Investigation of Inmate Grievance

Scharf Banks Marmor LLC represented the Sheriff of Cook County in a successful appeal before the Illinois Appellate Court, which affirmed  the disciplinary termination of a former Sheriff’s correctional officer after an inmate at the County Jail complained that money was missing from his trust account.  The former Sheriff’s officer was terminated following a Sheriff’s Office internal investigation of trust accounts at the Jail.  After the Circuit Court of Cook County affirmed the former officer’s firing, the officer appealed to the Illinois Appellate Court.  The Appellate Court found that the Sheriff’s investigation uncovered evidence of “two receipts for the same inmate on the same date, one of which was false,” and held that the Sheriff’s Merit Board properly fired the officer who was responsible for the false receipt.   The appellate Opinion, Wilson v. Dart, 2020 IL App (1st) 191532-U , is attached here.  The lead attorneys on this appeal were George Sax and Stephanie Scharf.   The Firm also won the earlier trial court judgment in favor of the Sheriff in July 2019, with George Sax and Morgan Churma as lead attorneys.
